The term ‘you’ refers to to all external parties, the users or viewers who wish to access or use the website and services in this website.
By accessing or using the Website and Services you agree to be bound by these Terms and Conditions. These Terms and Conditions are a contract between you and us which commences upon your acceptance of them. If you disagree with any part of these Terms and Conditions, please do not use our website and/or services. We may change and republish the Terms and Conditions from time to time. It is up to the user to regularly review these Terms and Conditions and note any changes.
GENERAL PROVISIONS
1) SMILES & MILES LTD company acts as an independent healthcare, health and medical tourism consultant and agents of selected medical care providers (clinics, hospital, health travel agencies, travel agencies) under special agreements.
2) Our website and company does not provide health & medical advice, opinion, diagnosis, treatment or any other health related procedures. All the information provided in this website is designed to share information, support for users to meet their service needs and consultancies to help for your healtcare, health & medical tourism options, needs and questions.
3) SMILES & MILES LTD. is not a tourism company nor a medical facilitator. We are a commission based healthcare solutions and Health Tourism & Medical tourism consultancy company. Non the less, we deal only with licensed & accreditated health tourism companies and medical treatment facilities (clinics & hospitals) in Turkey.
4) Our role is to act as a third party facilitator between the health&medical care providers and yourself to give the most transperant information with access to quality and world-class health & medical tourism services at affordable prices.
5) We adhere to Medical Ethics, Codes of Ethics and Practice, Patient’s privacy and wellbeing to get the best practice in the provisioning of healthcare and health & medical tourism procedures. Commercial interest must always remain subordinate in the health and well-being of the Person.
CONTACT & SERVICE REQUESTS
1) You can contact with us through our website, email, phone for the services you need and search for. We get initial personal information to find you the best and appropirate solutions according to your needs and requests. We do not collect your data, store it or share with the third parties. We must submit details of your current medical status and/or medical history to our contracted healthcare providers in Turkey. This is partly to ensure your suitability for the planned treatment. By accepting these Terms and Conditions, you agree to our sharing the details of your medical history, including your pictures, test results, prescriptions, x-rays, with the Healthcare Service Providers. We share the information gathered from you with our official health and medical tourism providers (Specialists, Clinics, hospitals, health travel agencies) to get the most informed data, to plan your treatment, travel, accommodation, ancillary services (city tours, special events etc.) and to give appropriate price to assist you to get the desired related service. For the usage, transfer and disclose of the Personal Data please read our Privacy Policy.
2) If you use our services, we may contact with you through the given contact addresses by you and ask for additional information to give you and receive you the best possible services. You may be required to provide medical history as well as the results of the preliminary procedure checks at your home country to get the best advise from the healthcare providers that we worked together.
3) You agree that your personal information and initial health assessment questions will be shared with our Healthcare Providers. We are not liable if your information has not been completed thoroughly or honestly, or if any information is withheld or incorrect.
4) We will not disclose your data, records or information without your consent and will only share it with our healthcare providers.
5) All medical & health services provided by us are consulted and performed by the medical personnel with appropriate qualifacitions in accordance with the applicable law in Turkey and registered under the Ministry of Health in Turkey.
PRICES OF SERVICES & PAYMENTS
1) The prices provided on our Website are given to have an idea about the costs range of the related services.
2) The price of the service may change according to your service preferences like, only testing, consultation or all inclusive packages. Depending on your choice of services, your offered price will include the costs of one or more of the following, pre treatment tests, surgery, medical procedures, accommodation, private transfers, hosts, any pre-operative tests you are advised to take or any additional tests you would like to get.
3) To get the exact service price we send you a detailed privaleged quote with the confirmed and guaranteed final prices for any service according to your needs and preferences. Our detailed initial privaleged quote includes options and prices from the healthcare providers.
4) Once you have accepted the price quote provided to you with binding these Terms and Conditions, you will be required to pay a consultancy fee & deposit to us. This consultancy & deposit fee will be the small percantage (10% -15%) of the total price, which is non-refundable. You may pay your fee via credit card, debit card or bank transfer.
5) The remainder of your balance, which is the total price minus the consultancy & deposit fee will be payed when you will arrive the destination and healthcare provider facility. Mostly the remaining amount is paid prior to preliminary tests, medical procedure, treatment.
6) For the itinary plan, you should buy your flight tickets and send us for the arrangement of accomodation, transfers and reservation in the healthcare provider facility, stay of hospital days.
HEALTHCARE SERVICES & TREATMENTS
1) SMILES & MILES Ltd does not provide medical advice nor does operate or control any Healtcare provider or Service Provider facility or services rendered by them. Your diagnostic tests, treatment, medical procedures is subject to a contract between you and the Healthcare provider that you have choosen. Before any diagnostic tests, treatment and/or medical procedures you shoud read and sign a consent form and/or another contract with the related health&medical care provider. We and our staff are neither responsible nor liable for any health tests, treatment, medical procedures or surgeries that you engaged at the choosen clinic or hospital.
2) SMILES & MILES LTD. is solely to facilitate a consultation and/or dialogue between you and your healthcare service provider. We strongly recommend that you read Service Provider’s terms and conditions and consent forms carefully prior to proceeding with your treatments.
3) The Consultation and treatment plans offered by us, as a result of email exchanges, telephone conversations or video consultations are solely based on the information (i.e. the pictures, test results, prescriptions, x-rays, etc) provided by you and reviewed by healthcare service provider. Therefore, your treatment plan may change when you arrive the healthcare service Provider facility and healthcare professional examines you in pre-treatment procedure in face to face and/or preliminary diagnostic tests.
4) In such circumstances, you have the right not to go ahead with the proposed treatment, you will receive a refund after deductions for other orginzed things, such as pre-consultation, tests. Nevertheless we are not responsible for refunding any of your accommodation, travel, transportation costs, as all these arrangements are made through by your self or any third party providers, which are not in our control nor operated by us.
5) If the treatment plan changes after prelimanry consultation and you would like to go with the new treatment plan, the quatation and the duration of stay may also change. We do not take any responsibility for this and cannot be held liable for the non-arrangement or disorganisation of extra days stayed or extra cost of stay.
6) You totally agree to indemnify SMILES&MILES LTD. and our personel against the incidence of medical negligence or malpractice. These aspects will invariably be governed by another contract, consent form or terms and conditions with the related Healthcare & Medical Care Provider.
7) We do not accept any responsibility in the unlikely event that the Healthcare Provider feels that you are not fit enough to undergo surgery and have to return without your surgery, or procedure, taking place. You will be entitled to refund of any unspent balance of your treatment cost after deductions on account of tests, consultations, etc.
8) Your Healthcare Provider will give you aftercare instructions and advice. If you should not follow these and there are repercussions arising from your own lack of care, the HealthCare Provider will not accept responsibility and other parts of this agreement may be void.
9) SMILES & MILES Ltd. does not accept any liability for loss or injury of any kind except death or injury caused by the negligence of the company, its servants or agents.
OUR RESPONSIBILITIES
1) As part of our services and this contract, according to the information that we get from you, we will provide you a Personalized Consultancy Report with containing the following information:
· Detailed Information about your treatment procedure;
· Detailed information about the costs
· Deatiled information about the healthcare service provider and/or agency
· Detailed information about the accomodation and transfer
· Detailed information about visa and passport requirements (this information can also be obtained from https://www.evisa.gov.tr/en/)
· Information about health formalities required for the journey and the stay

2) After you will make the consultancy & deposit fee payment to us and sharing your flight tickets, we will provide you the most itinary plan for your journey and treatment with all detailed information. This information will be provided in good time and will include the following:
· The times and places of VIP transportation,
· The name, address and telephone number of your healthcare service provider or of an health tourism agency who will wellcome you and assistance you.
3) We do not operate and control the services of third party service suppliers, health tourism agency, healtchcare provider, transfer agencies, which they will provide you the travel, accomodation, transfers or tours. We are not liable for any damages, problems, arising from the transactions between you and third party healthcare provider, healthcare agency, accommodation, travel or transfer providers.
4) There can be cancellations or change of cooking due the circumstances beyond our control or healthcare providers control or force majeure like; a) Flight delays or cancellations, b) Terrorist activity, war, c) Civil unrest, strike, d) Bad weather such as hurricane, flooding etc., e) Earthquake, f) Epidemic or pandemic, g) Acts of God or other natural disasters. In such cases we will contact with you, with the prove of such circumstances and can cancel your booking, re-arrange your booking that you will get a refund calculated on a scale from the whole price.
YOUR RESPONSIBILITIES
1) You will peruse the all documents, quotations, reports, forms made available to you, including information contained on our website before you accept this Terms & Agreement. By accepting this agreement you accept and agree that you have read and understood the all information made available to you.
2) You and all participants with you must be in possession of a valid passport during time of travel, depending on length of visit, a Visa may be required for some or all of the countries visited. Please check your visa requirement at time of booking. You must meet the entry requirements for both your final destinations and if any connecting flights destination. We do not accept responsibility for your missing your flight, including your connections. You are responsible for providing all necessary documents, including passports and visas.
3) We do not have any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. You are advised to seek such insurance arrangements in your home country before commencing travel. All baggages and personal property/s at all times are at your’s risk.
4) You should get health advice about your specific needs, or any required or recommended vaccinations, or any requried tests before or after travelling.
INDEMNITY
You agree to indemnity and hold harmless SMILES&MILES LTD, it’s proprietor, subsidiaries, affiliates, officers, agents and other partners and employees from any loss, liability, damage, injury, claim or demand, cost and expenses including reasonable attorney fees and litigation expenses made by any third party due to or arising from your use of this Site, any Site Materials, or services obtained on or through this Site, any arrangements you create supported information obtained on or through this website, or any breach by you of this Agreement.
AND you agree to save and indemnify SMILES&MILES LTD, from and against every and any claim of any nature or kind whatsoever that any third party can, shall or may hereafter have against SMILES&MILES LTD, including without limitation claims, demands, damages, actions, causes of actions, costs and expenses arising out of or relating to any death, injury, loss or damage (such as disability, loss of capacity, pain and suffering, medical or surgical complication), howsoever caused, arising directly or indirectly out of or in connection with your travel to, from, or within any country and/ or any medical treatment and/or surgical procedures undergone and/or any diagnostic tests&reports / by you in Turkey.
APPLICABLE LAW AND JURISDICTION
This Agreement is governed by the law of England and Wales, and is subject to exclusive jurisdiction of the courts of England and Wales.
ACCCEPTANCE OF TERMS
By using this website and/or our services, you signify your acceptance to our terms and conditions, if you do not agree with these terms and conditions, then you may not use this website and/or our services.
